This privacy statement discloses the privacy practices of the Web site of Grupo Empresarial de Transporte Turístico TRANSTUR, S.A., a Cuban corporation, commonly known as TRANSTUR, S.A., with registered office at Calle 19 # 210, entre K y J, Vedado, municipality Plaza de la Revolución, province Havana, country Cuba, constituted by Notarial Deed No. 140 dated December 8, 2004 and registered in the Central Mercantile Registry attached to the Ministry of Justice of the Republic of Cuba, in Volume No. XIII, Folio No. 180, Page No. 008, first inscription, hereinafter TRANSTUR, S.A.

Purpose of these Privacy Rules

At TRANSTUR, S.A., we recognize the importance of protecting the personal information you provide to us (such as your name, e-mail address and other contact information, collectively and hereinafter referred to as "PII"). This Privacy Policy sets forth our criteria with respect to the collection, use and disclosure of your PII through our online and offline operations.

This Privacy Policy reflects TRANSTUR, S.A.'s efforts to better serve you by keeping you informed of promotions, products and services, while at the same time protecting your PII. Our intention is to provide you with offers and discounts that we believe are relevant to your interests and are offered by and through TRANSTUR, S.A. and its affiliates and other non-affiliated companies with which we maintain business relationships. 

This Privacy Policy is included in, and forms part of, the Terms and Conditions of Site Use governing the TRANSTUR, S.A. website at www.rentcarcuba.com (the "Site").

This privacy statement governs the www.rentcarcuba.com website. As we wish to demonstrate this website's commitment to safeguarding your privacy, we have agreed to disclose the information procedures used and to continually review our compliance with our privacy policy.

If you have any questions or concerns about this statement, you should first contact TRANSTUR, S.A. by e-mail at cubacar@transtur.cu. If you do not receive confirmation that your message has been received or if your inquiry has not been satisfactorily addressed, you may contact us through the contact addresses present on the Site. However, we would like to clarify that these rules only cover information that is collected through this Site, so it does not cover information collected through software or offline means.

What personal information TRANSTUR, S.A. collects and how it does it

When you make a reservation, rent a vehicle and/or join any of TRANSTUR, S.A.'s programs, we need to collect certain information about you in order to offer and improve our services. The type of information we collect depends on the service you choose. Among other information, this information may include:

Name

E-mail address

Home and/or work address

Contact telephone numbers

Date of birth

Driver's license and the province/country that issued it.

When you rent a vehicle, we may also record information about it (e.g., rental location, location and date you returned the car, payment arrangement, insurance preferences, fuel consumption, mileage, and other vehicle-related data).

We may also need certain information from you when you request any of these services and/or equipment: Optional or special needs equipment, special offers/discounts, customer number (in case you belong to our loyalty program) and other preferences regarding the vehicle. For example, if you wish to use a discount that TRANSTUR, S.A. offers to members of its loyalty program, we may ask you for information that will allow us to verify your membership and provide you with the correct discount for our services.

How we collect information will depend on how you use our services. We may collect information directly from you by telephone, e-mail, at our office counters, through application or subscription forms you fill out, or through our Site or the Internet. To enhance your use of our Site, we may also collect information about your visits, account and transaction information, e-mail and other information related to communications with our Site. Similarly, we may obtain information about you indirectly through a travel agency, an account program in which you or your employer participates or one of our partnership programs when you do business with us through those means. Our affiliates and third parties may also provide us with information about you.

You may choose not to disclose some of your PII to us, but this may impede your access to our services or limit our ability to provide you with the level of services you would normally expect from us.

How TRANSTUR, S.A. uses and shares your personal information

Use

We strive to provide you with a hassle-free rental experience and are dedicated to building a pleasant and lasting relationship with each of our customers. In order to provide you with the level of service you have come to expect from us, we may use your PII for the following purposes:

To provide the services and offers you request, and to communicate with you regarding such services and offers;

To do all things necessary to administer those services;

To research, develop, maintain, protect and improve our Site and our services;

To maintain and develop our service-oriented software and other business systems;

To analyze data or hire a third party to do so for us.

In addition, we use your PII or some of your PII, such as your email address, for other purposes. For example, such information may be used to process and track your transactions and to send you information about our affiliates' and business partners' products and services, as well as other information and materials that may be of interest to you. If you use our Site, the information may also allow us to evaluate which parts of the Site receive the most visitors, as well as to determine where visitors come from, where they go and how long they stay on a particular page or on our Site in general.

We may compare information collected from you by different means or at different times, including, for example, information collected online and offline, and use such information in conjunction with data collected from other sources, including third parties. To do this, we are often required to share this information with certain carefully selected vendors and business partners with whom we work, such as account management companies, companies that provide affinity, frequent user and rewards programs, and companies that perform services and other business operations for us. Disclosure

We may disclose your PII to affiliated and nonaffiliated organizations, including, for example:

Your company or organization, if you use our services through a corporate or business account;

One of our program partners (for example, if you are a member of a frequent flyer program and have requested that we send you detailed information about the rental contracts you have with us to obtain the benefits of that program);

Entities that provide their services on our behalf;

The issuer of your credit cards; 

Credit and fraud reporting institutions;

Companies engaged in debt collection, in case you do not pay any amount owed to TRANSTUR, S. A.; 

Governmental or private organizations in charge of the processing or handling of traffic or parking violations;

Driver licensing authorities, either directly or through intermediary organizations, when required to verify whether qualified drivers meet safe driver criteria and/or to verify license information; and

Governmental, regulatory and law enforcement agencies when the provision of this information is required or authorized by law, as well as in cases where we deem it necessary or appropriate to satisfy any law, regulation or other governmental request, to operate our Site properly or to protect or defend our rights or the rights or welfare of our employees, users or other persons or in the event that you are involved (or suspected by governmental authorities or our law enforcement of being involved) in any illegal activity, even without a subpoena, warrant or court order having been issued.

In addition, we may disclose your information to our affiliated companies and our nonaffiliated business partners for their use on our behalf and for their own business purposes. For example, our affiliates and business partners may use such data to send you information about their products and services and other information and materials that may be of interest to you. You are free to agree or object to our disclosure of your PII for these purposes. 

We may also share your information with other nonaffiliated third parties, such as entities that provide services to and through our Site or our company (e.g., advertisers, ad servers, content providers, service providers, credit card processors, order processing service providers, email list hosting companies, and distribution companies) who use such information on our behalf in accordance with this Privacy Policy. Such third parties may not use your information for other purposes.

We may also transfer or assign your information to third parties as a result of or in connection with a sale, merger, consolidation, change of control, transfer of assets, reorganization or liquidation. Website Tracking and Use of Cookies and Other Technologies

 If you use our Site, certain PII may be collected during your time on the Site. As many other websites do, we may use “cookies” and/or other technologies (e.g., web bugs, email bugs, clear GIFs, web beacons, web beacons, tracking GIFs and other data logging mechanisms) on our Site and other websites, or in our electronic communications with you, to enhance the functionality of our Site and our services and to provide you with greater convenience and efficiency in conducting your transactions and other activities. These technologies may vary, but in many cases require a small file to be stored locally on the computer used to access our Site (commonly referred to as a cookie), and may be used to store and collect information related to your visits to and use of our Site and our correspondence with you.

We may use cookies to track trends and patterns of use of the Site. This helps us to better understand our users' needs and improve areas of our Site. We may store the information we obtain through cookies for the purpose of creating a profile of our users. The profile is information we maintain about each user regarding their travel preferences, rental history and behaviors, and if used would eliminate the need for the user to re-enter their information on our Site. Accordingly, the information we collect is related to the user's PII and allows us to provide offers and improve our services and the content of our Site.

Most cookies expire after a set period of time or you can delete your cookie file at any time. Most Web browsers are initially set to accept cookies. You can set your Web browser to refuse cookies or to indicate when a cookie is being sent. However, some parts of our Site will not function properly or may function much slower if cookies are refused. For example, without cookies, you may not be able to set personalized preferences and/or may have difficulty making transactions.

We may obtain your computer's Internet Protocol (IP) address and domain name address, the identity of your Internet access provider, the type of Web browser software you use, your computer's operating system, the URL of the Web page from which you came to our Site, and the language you selected for your Web browser software (collectively, "clickstream data"). We may use third-party service providers to serve advertisements on our behalf across the Internet and sometimes on this site.  They may collect anonymous information about your visits to our Web site, and your interaction with our products and services.

Web beacons 

Web pages may contain an electronic file called a web beacon that allows the Site to count users who visit that page or who have access to certain cookies. TRANSTUR, S.A. may partner with sites or organizations that use web beacons to: 

- conduct research on behalf of certain partners on their websites and also for auditing purposes.

- report aggregate information about users to our partners. This aggregate information may include demographic and usage information.

Links to other websites

Our Site may contain links or references to other websites that are beyond our control, and the privacy practices of these sites may differ from ours. Please remember that we have no control over such websites and that our privacy policy does not apply to such websites. We recommend that you review the privacy policies of such sites before disclosing any PII through them.

Third-party site

Occasionally, when you select a link on the Site to go to another website, you will probably still see our Site logo or information from TRANSTUR, S.A. This is done to provide you with a seamless experience when you visit our website. In these cases, you are no longer on our Site, but on a different website, which is not owned or controlled by TRANSTUR, S.A. and, therefore, the information collection practices of the third party website may be different from those of TRANSTUR, S.A. The privacy policies of a third party website will govern how information collected about you is used by the website owner. You can always find out which website you are on by checking the location bar within your browser.

How We Protect Your Personal Information

The security of your PII is extremely important to us. When it comes to implementing commonly accepted technology security standards for your critical PII, we take great care to protect the information we collect through our Site from loss, misuse or unauthorized access, disclosure, alteration or destruction.

Unfortunately, "perfect security" does not exist on the Internet, and no data transmission over the Internet can be guaranteed to be 100% secure. Accordingly, while we strive to protect your information, we cannot guarantee that information stored on our servers, or transmitted to or from a user, will be free from unauthorized access. For example, and in particular, unencrypted e-mail does not represent a "secure" means of communicating with us, as e-mail may be intercepted by a third party while being transmitted. By using our Site and corresponding with us, you acknowledge that you understand and agree to assume these risks.

In all applicable cases, you are responsible for maintaining the strict confidentiality of your account password, membership numbers and personal identification numbers, and it shall be your responsibility if you or any person or entity using a password provided by you accesses or uses our Site, whether or not such access or use was authorized by you or is made on your behalf, and regardless of whether such person or entity is your employee, relative or agent. You agree to (a) immediately notify us of any unauthorized use of your password, account number or membership or any other security problem, and (b) ensure that you exit from your account at the end of each session. It is your sole responsibility to control the dissemination and use of your password; to control access to and use of your account number and membership; and to notify us when you wish to terminate your account on our Site. We will not be liable for any loss or damage arising from your failure to comply with this provision.

We will never ask you to send us PII of critical importance, such as your credit card number, password, membership number or personal identification number in an e-mail message or through a website that is not located within the domain of this Site. If you receive an e-mail or any other correspondence requesting you to provide such information by e-mail or through a web site that is not located within the domain of this Site, please do not do so and immediately inform cubacar@transtur.cu of such request.

In the unlikely event that we believe that the security of your PII in our possession and control has been breached, we may attempt to notify you of such an event. If such notification is appropriate, we will endeavor to notify you as soon as possible under the circumstances and, if we have your e-mail address, we may send such notification via e-mail.

Applicable Law and Jurisdiction

This Privacy Policy will be governed by the laws of Cuba, without regard to conflicts of laws principles. By providing us with your PII, you acknowledge that you fully understand and authorize the transfer of such PII to, and the collection and processing of such PII in, Cuba and other countries or territories. You agree that any legal proceedings relating to this Privacy Policy shall be brought and resolved in the competent court in Cuba. You further agree to submit to the personal and exclusive jurisdiction of the competent court in Cuba.

Changes to this Privacy Policy

We reserve the right, at our discretion, to change, modify, add or remove portions of the content of this Privacy Policy at any time, so we encourage visitors to review the policy at the beginning of each session.

Customer Acceptance of this Privacy Policy

By using our Site, or otherwise providing us with your PII, you confirm that you agree to our Privacy Policy. If you do not agree to this policy, please do not use our Site or provide us with your PII.
